Welcome to M&B Collectibles. These Terms of Service (“Terms”) govern your use of our website and online store (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Definitions

“You” refers to the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

“Goods” refer to the trading cards and collectibles listed for sale on our Service.

2. Use of Service

2.1 Eligibility

You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

3. Purchases

3.1 Pricing and Availability

All prices are listed in CAD (Canadian Dollars) and are subject to change without notice. We reserve the right to modify or discontinue any product without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the product.

3.2 Payment

We accept Visa and Mastercard for all transactions. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.

3.3 Shipping

Shipping costs and estimated delivery times will be provided at checkout. We are not responsible for delays in shipping due to circumstances beyond our control.

3.4 Returns and Refunds

Our return and refund policy is outlined in a separate document, which is incorporated into these Terms by reference.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of M&B Collectibles and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

5. User Content

You retain any and all of your rights to any content you submit, post, or display on or through the Service and you are responsible for protecting those rights.

6. Prohibited Uses

You agree not to use the Service:

a) In any way that violates any applicable federal, state, local, or international law or regulation.

b) To impersonate or attempt to impersonate M&B Collectibles, a M&B Collectibles employee, another user, or any other person or entity.

c) To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm M&B Collectibles or users of the Service or expose them to liability.

7. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. M&B Collectibles makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

8. Limitation of Liability

In no event shall M&B Collectibles, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless M&B Collectibles and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Nova Scotia, Canada, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect.
